Terms and Conditions

Websites, social media, and any other service channels are created and maintained by Maewkhonthong Co., Ltd. ("Strayandcool") with the purpose of disseminating information about services and information related to Strayandcool to facilitate users ("You") in using services including various products and/or goods of Strayandcool.

Your use of Strayandcool's service channels is subject to these terms and conditions, and it is deemed that you have accepted the terms of service set by Strayandcool. Your use of the service creates legal obligations as specified in all terms and conditions of service, which you have read, understood, studied in detail, and which you accept and agree to be bound by.

Intellectual Property

All products, services, information, text, documents, images, animations, audio, logos, or anything else, including but not limited to copyrights, trademarks, service marks, patents, petty patents, trade secrets, etc., appearing on all Strayandcool service and sales channels, are rightfully protected under intellectual property laws, whether registered or not, and are the proprietary works of Strayandcool.

You agree, consent, and acknowledge that you will not commit any act that infringes upon Strayandcool's intellectual property. You will strictly not use Strayandcool's intellectual property for commercial purposes or for seeking profit or personal benefit. Including you will not alter, modify, reproduce, or duplicate Strayandcool's intellectual property. Furthermore, if any legal disputes arise, you agree to waive any right to claim in any civil or criminal proceedings against Strayandcool.

Changes, Modifications, and Service Channel Regulations

Strayandcool reserves the right to change, modify, and determine the use of any of Strayandcool's service channels without prior notice to you. You agree to regularly check for changes, modifications, and usage rules of service channels, including any additional terms. Your use of any Strayandcool service channels may give rise to legal agreements and/or contracts under any terms and conditions that have been fully amended or changed.

Your Use of Service

You agree, acknowledge, and accept that you will use the service website including Strayandcool's service channels for lawful purposes and only under the terms and conditions specified by Strayandcool. You will not use this website or Strayandcool's service channels for personal gain, commercial gain, or any other gain that is contrary to the law and public morality.

If you are under 18 years of age, accessing the service must be under the supervision of your parent or guardian. You are obligated to follow the rules set out in these terms and conditions as an ordinary person. If any of your actions violate these terms and conditions, your parent/guardian and you must jointly be liable to Strayandcool as specified.

You are also responsible for messages, photos, still images, animations, videos, comments, ratings, and providing information in any format ("Content") that you transmit or pass through Strayandcool's service channels and including any other channels where you mention Strayandcool. You assume all risks and full responsibility. You agree that your content must be lawful, not infringe on the rights or intellectual property of both Strayandcool and others. You agree to refrain from any content containing false, defamatory, misleading, insulting, hateful, harassing, nuisance-causing, obscene messages, etc.

You agree and accept that:
1. Strayandcool has the right to screen your content at any time.
2. Strayandcool has the sole discretion to delete your messages or ratings when published.
3. Your comments on Strayandcool's services and/or products will be accurate and true in all respects.
4. If your content infringes upon the rights or intellectual property of any other person, you will be solely responsible directly and indirectly.

Limitation of Liability

Under no circumstances shall Strayandcool, including but not limited to executives, shareholders, managing directors, directors, employees, staff, agents of Strayandcool, be liable to you, other persons, or any other legal entity for any direct and indirect damages, resulting in punitive damages, including but not limited to damages from loss of profit, loss of data from use, arising from accessing or using all of Strayandcool's service channels, whether as a warranty, contract, tort, or any other case, even if Strayandcool knew or should have known of the possibility of such damages or losses. You acknowledge and agree that this content applies to all products and services of Strayandcool.

For Strayandcool's products, Strayandcool reserves the right to disclaim responsibility for all types and cases of warranties, including defects or damages that may arise from failure to follow instructions or explanations in using Strayandcool's products and/or services, including misuse or modification, and it is deemed that you have thoroughly read and acknowledged the use of Strayandcool's products and/or services.

Force Majeure

Strayandcool is relieved from all liabilities in the event of force majeure such as pandemics, wars, terrorism, natural disasters, riots, or shortages of materials or anything else to assemble into products, or cases of service disruption from such force majeure.

Remediation and Indemnification

You agree to remediate, indemnify, compensate, and/or protect against any damages occurring or that may occur to Strayandcool, which includes but is not limited to executives, shareholders, managing directors, directors, employees, staff, agents of Strayandcool, from any claims for damages and/or expenses claimed by third parties and/or outsiders (including legal fees incurred from exercising legal rights) arising from your use of Strayandcool's service channels or your violation or breach of the terms of use.

No Agency or Representation

The stipulations and these terms and conditions are not intended to appoint any principal-agent, partnership, joint venture, employer-employee relationship between you and Strayandcool in any way.

Unless explicitly stated otherwise in writing, if you wish to give notice or send any letter, you acknowledge that it must be sent to:

Or in case Strayandcool will notify you, Strayandcool will send it via the email you provided or notify via Line Application. In such a case, it will be deemed that you have received the notice from Strayandcool from the time Strayandcool has sent or is deemed to have sent the notice.

Jurisdiction and Governing Law

The use of Strayandcool's service channels is under the jurisdiction of the Kingdom of Thailand, and you agree that the governing law is Thai law, without regard to conflict of law principles. This shall apply to the terms of use and/or any disputes that may arise between you and Strayandcool. The jurisdiction of the Kingdom of Thailand is the jurisdiction with authority to consider and conduct any legal proceedings entirely.
